HUMAN RIGHTS AND PUBLIC HEALTH EMERGENCIES

Many people believe that if American society devolves into totalitarianism it will be as the result of some natural disaster or public health emergency. The public's confidence in the government's ability to protect individual rights in the face of a public safety emergency was not bolstered by the government's performance during the aftermath of Hurricane Katrina, when law enforcement went house to house confiscating firearms from citizens stranded in their homes. You can find a lot of references on the internet among conspiracy theorists that FEMA has already been tasked with administering martial law and that detention camps have already been built. The Medical Law Review published an article in 2009 which argues, from a Global perspective, that any public policy planning for public health emergencies should have a strong human rights component that should ultimately be codified in both international and national laws.
